1. About these terms.
1.1. What these terms cover. These are the terms and conditions on which you may take part in our Ooni referral programme (the “Referral Programme”).
1.2. Why you should read them. Please read these terms carefully before you agree to take part in the Referral Programme. They tell you who we are, how the Referral Programme works, how we may change or end Referral Programme, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
2. Information about us and how to contact us
2.1. Who we are. We are Ooni GmbH, a company registered in Germany.
Our parent company is Ooni Limited, a company registered in England and Wales. Ooni Limited's registration number is 08316049 and our registered office is at Walderslade Accounting Services, 105 Hopewell Business Centre Unit 20, Hopewell Drive, Chatham, Kent, ME5 7DX. Our place of business is at Ooni HQ, Bishopsgate Business Park, 189 West Main Street, Broxburn, EH52 5LH.
2.2. How to contact us. You can contact us via our support portal, or by writing to us at firstname.lastname@example.org, or by mail to our business office at Ooni HQ, Bishopsgate Business Park, 189 West Main Street, Broxburn, EH52 5LH.
2.3. How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us:
(a) where you are an “existing customer” (as defined below), when you completed the online form referred to in clause 4 below; or
(b) where you are a “friend” (as defined below), who has been referred to Ooni by an existing customer when you provide your details to us on ooni.com (if you do so).
3. The Referral Programme
3.1. What the Referral Programme allows you to do. The Referral Programme allows any eligible existing customer of Ooni (an "existing customer") to refer a friend or family member (a "friend") to the ooni.com online store.
3.2. What you get if you are referred by an existing customer. If you are referred to us by an existing customer between 18 and 20 November 2022, you will receive a discount code for 20% off your first purchase from the ooni.com online store (a "20% Referral Code"), subject to these terms and conditions (in particular, clause 6 below).
4. How to refer a friend
(b) click on the ‘referral programme' button and follow the steps to receive your unique referral link;
(c) share your unique referral link with your friends;
(d) each friend that uses your unique referral link will have their 20% Referral Code automatically applied to their first purchase on ooni.com;
(e) if a friend that you have referred makes a qualifying purchase of more than €200 you will receive an email with your Reward Voucher to the email address that you supplied to us when you generated your referral link (pursuant to paragraph (b) above).
5.1. If you are referred to us by an existing customer. If you are referred to us as an existing customer, and you chose to take part in the Referral Programme by using your 20% Referral Code, we will assume that you have read and agreed to these terms and conditions and that you meet the eligibility criteria set out in clause 3.4 above.
Other than as set out in these terms and conditions, any purchases made through ooni.com (including purchases made using 20% Referral Codes and/ or Referral Vouchers) are subject to our general terms and conditions of sale which can be found at https://eu.ooni.com/pages/terms-and-conditions.
Your statutory rights and your rights under our general terms and conditions of sale. Your participation in the Referral Programme does not prevent you from exercising any of your rights under our general terms and conditions of sale and does not affect any statutory rights you may have, including your rights under the Consumer Rights Act 2015.
10.3. We are not liable for business losses. The Referral Programme is only available for products for domestic and private use. You may not use the Referral Programme for any commercial, business or resale purpose. If you do use the Referral Programme for such a purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
11.1. How we will use your personal information.
(a) We will use the personal information you provide to us:
(i) to assess your eligibility for the Referral Programme;
(ii) to provide any 20% Discount Code to you;
(iii) to provide any Referral Voucher to you;
(iv) to enforce our rights under these terms and conditions; and
(v) if you agreed to this during the referral process, to give you information about similar products that we provide, but you may stop receiving this at any time by contacting us.
(b) In addition, if you purchase a product from us, we will use the personal information you provide to us for the purposes set out in our general terms and conditions (referred to in clause 8 above).
(c) We will only give your personal information to third parties where the law either requires or allows us to do so.

13.1. We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
13.2. You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
13.3. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
13.4. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect..
13.5. Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
13.6. Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
